Urge members of the House K-12 Subcommittee to SUPPORT HJR 92 to protect homeschooling in our state constitution.
House Joint Resolution 92 proposes an amendment to Article XI, Section 12 of the Tennessee Constitution, affirming and protecting the rights of parents to direct the education of their children, particularly through home-based education. The amendment explicitly states that parents have an inherent and fundamental right to make decisions regarding their children’s upbringing, including their education. It further prohibits the state or any political subdivision from interfering with a parent’s right to provide home-based education through the adoption or enforcement of laws or rules that infringe upon or restrict this right.
Additionally, the amendment ensures that no regulatory requirements shall be imposed on home-based education by the state or any of its subdivisions. It also clarifies that the state cannot compel attendance at any specific educational institution or enforce compulsory attendance laws in a manner that limits a parent’s ability to homeschool their child.
By enshrining these protections in the state constitution, the amendment seeks to solidify parental rights in education and safeguard homeschooling from government interference, reinforcing the principle that parents—not the state—hold the ultimate authority in directing their children’s education.
